Since 8 November 2023, nitrous oxide has been classed as a Class C controlled drug in the UK. It is illegal to possess nitrous oxide with intent to wrongfully inhale it for a psychoactive effect, and illegal to supply it to someone else for that purpose.
That change was aimed squarely at recreational misuse — it did not remove the long-standing exemptions for legitimate uses, which remain lawful. These include catering and food production, medicine, dentistry, and industrial or engineering applications. Nitrous oxide used as a food propellant is separately recognised as food additive E942, approved for use in food production under UK and EU food safety regulation.

Buying cream chargers for genuine culinary use — making whipped cream, mousses, foams or infusions — is lawful. The law targets possession or supply intended for recreational inhalation, not the legitimate food-service and home-cooking use our products are sold for.
What is food-grade N2O (E942)?
Nitrous oxide used as a food propellant is registered as food additive E942, approved for use in food production under UK and EU food safety regulation. Food-grade N2O meets strict purity requirements (typically 99.5%+ purity) that are separate from — and stricter than — general industrial-grade gas.
